Opinion 29. Are you asking for my comments or just expressing some ideas to readers ? If you have asked for my comments–if owner of this shop can, according to his/her income projection from the business ( which wil have to submit with the application), earn, net after total costs and taxes , of , say, $ 40000 or more per year from the business, this business will be eligible for E2 visa application if a Thai or Thais own 100%. Why did I say so ? Because the owner can financially support himself and family.This is the important point among other things which the USCIS considers under the E2 visa scheme. ( “Other things” are for example that the applicant and family members have no criminal records.) No need to employ locals.
The Investment Treaty with the US is reciprocal i.e. what the Americans get from us, Thais get same. The Treaty does not impose on the Americans ( company or individual person) who invest in Thailand to employ Thais ( but of course due to the size of their investments in practice they will do if they want to set up factory in Thailand) to enjoy the Treaty. If Thais apply for E2, we therefore will not have to employ any local.
Again. If someone wishes to buy the business in the US to apply for E2 visa, please negotiate to have the term in the contract that the payment for the price of the business will be made when the buyer and his family get E2 visa.This term is not unusual and is acceptable to the US Embassy in BKK. Do not pay before you or you and your family are granted with this visa.
