Landlord Tenant Law – Security Deposit Return. – Get your deposit back!- #LegalFoxTV


In this video we go though the process of getting your security deposit money back from your landlord and how landlords should handle returning it.
It is a legal lesson minus the frills of the full Legal Fox ‘episodes.’ Just straightup legal talk! (Please excuse the echos.)
It is focused on Florida law, but the procedure may be similar to many other states. Of course, always check with an attorney licensed in your State!

\”Hey everyone, what’s up? Legal Fox here giving you a quickie little shoutout video that hopefully you might find helpful!
Today we’ll talk briefly about Landlord/ Tenant law, specifically about getting your security deposit back!
I know that’s a sore spot for many people. Fortunately, they are laws out there that are really strict.
Often times tenants complain, “ It’s been months and where is their security deposit?”
The laws vary from state to state but I’m licensed in Florida and New York so I’ll use Florida as an example. In Florida the law specifically states that the landlord only has 15 days to return your security deposit. However if they intend to \”impose a claim\” which means they want to take money away from your deposit because, for example, you tore up a rug or did something beyond normal wear and tear they have to notify you by certified mail (to the address you’ve provided them with) specifically why they’re imposing a claim AND it has to be within 30 days after you vacate.
And listen up this is really important… You, tenants have some obligations too. You have to notify the landlord within 15 days of them notifying you of their intent to deduct money that you object to that. Let’s say you move out on June 1 and June 15 comes and no money comes and you are starting to get worried. On June 20th you get a letter from your landlord stating that out of your $2000 deposit they are going to retain $500 because of damage to the carpeting. If you don’t object they will go ahead and return the balance. If you do have an objection, you have 15 days to notify them. You must notify them in this example by July 5th. If you don’t give them that notice that there’s objection then they have the right to deduct the money without you having any further recourse.
One really important thing to know … Landlord/ tenant law brings the right to “prevailing party attorney fees.” This means that if you have to see your landlord because, for example, they didn’t give your security deposit back and the court finds that she or he didn’t follow some simple procedure he or she could be liable to pay all your attorneys fees. So there really is an incentive here for our all parties to comply.
The converse holds true as well. The landlord could technically ask the tenant to reimburse them for their attorneys fees if there is some part of the contract that was violated or a statue.
BOTTOM LINE: There’s many statutes/laws that protect you as a tenant and ones to protect landlords as well.
